BirdPerch Terms of Use
By downloading or using BirdPerch, you agree to these terms. Because you get the app from the App Store, Apple's Standard License Agreement (EULA) also applies; these terms supplement it.
Contents
1. The service
BirdPerch is an app where you create your own bird, interact with it, track its care and get AI-assisted suggestions. It is provided by Ahmet Emin Tayfur.
2. BirdPerch Plus subscription
- Plus is an auto-renewing subscription with monthly and yearly options. Current prices are shown in the app in your local currency.
- The yearly plan may include a 3-day free trial for eligible users. Unless you cancel at least 24 hours before the trial ends, the yearly price is charged when it ends.
- Payment is charged to your Apple account when you confirm the purchase (with a trial, when the trial ends).
- The subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends.
- You can manage or cancel your subscription in Settings by tapping your name, then Subscriptions. Cancellation takes effect at the end of the current period.
- Refund requests are subject to Apple's policies and are made at reportaproblem.apple.com.
- When Plus ends, your Plus-only choices return to their free equivalents; when you subscribe again, they come back on this device unless you changed them in the meantime.
3. AI features and their limits
- Gaia provides general information. It is not a veterinarian, does not diagnose and does not recommend treatment. Make decisions about your bird's health with an avian veterinarian. In an emergency, see a vet right away.
- The score and results from Let's look at the cage are an estimate based only on a photo. They don't guarantee that a cage is safe and may miss risks; always check your cage yourself.
- Let's find its colors picks the closest species and colors from the app's options; the species or colors may be wrong, and an exact match is not guaranteed.
- Talk with my bird is an entertainment feature; it doesn't use AI, and your recording is processed only on your phone. It doesn't understand words or translate into bird language.
- The Journal is a personal tracking tool, not a medical record.
- AI answers may be inaccurate or incomplete. AI features have usage allowances; the app tells you when you're down to your last ones or have run out. These allowances may change over time.
4. Your content
The messages and photos you send, and the journal entries you let Gaia read, belong to you. You allow us to process them, through our server and Anthropic's AI service, only to provide the feature you request. Do not send content that is unlawful or infringes others' rights.
5. Acceptable use
You agree not to misuse the app, attempt to bypass usage limits, reverse engineer the app or our servers, or probe them with automated tools. We may restrict access if these terms are violated.
6. Intellectual property
The app, including its designs, characters (including Gaia), images, sounds and software, belongs to Ahmet Emin Tayfur or is used under license. You receive a limited, non-transferable right to use it for personal, non-commercial purposes. Recordings in Bird Sounds are used under their own licenses (public domain, CC0, CC BY and CC BY-SA), which these terms don't restrict; credits and licenses are listed on the Sound credits page.
7. Limitation of liability
The app is provided “as is”. To the extent permitted by law, we do not guarantee that it will run without interruption or errors, and we are not liable for damages arising from decisions based on AI answers or analysis results. Your statutory consumer rights remain unaffected.
8. Changes
We may update the app, its features and these terms. For significant changes, we update the effective date on this page and, where needed, also let you know in the app. Continuing to use the app after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of the Republic of Türkiye. Istanbul courts and enforcement offices have jurisdiction over disputes; your right to apply to consumer arbitration committees and consumer courts is reserved.
